Vibe The Trek Terms and Conditions

Introduction

These Terms and Conditions (“Terms”) govern the use of the Trek Up Tour website and services (“Services”) offered by Vibe The Trek (“TUT,” “we,” or “us”). By accessing or using the Services, you (“you” or “user”) agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Services.

Booking and Payment

  • Booking a trip: Booking a trip with TUT constitutes a contract between TUT (First Party) and you (Second Party). Both Parties are hereinafter referred to as (“Parties”). Booking signifies your unconditional acceptance of these Terms. These Terms are binding on you and all travel companions booked by you.
  • Risk: Trekking, mountain climbing, and mountaineering in the Himalayas carry inherent risks. TUT does its best to minimize risks, discomfort, and hazards. However, accidents, mishaps, and service deficiencies can occur. You must agree to these Terms. Please read them carefully before booking.

Promotions

  • Images: Pictures on the website and marketing materials are for illustration purposes only. They do not imply inclusion of the visuals in your trip or guarantee that you will experience what’s depicted.

Fitness Requirements

  • Trip difficulty: TUT offers trips with varying fitness levels. Difficulty is based on physical exertion, terrain, weather, and climate. Some trips might be physically demanding.
  • Medical advice: TUT is not a medical professional. Obtain medical advice and latest health requirements, including vaccinations, before your trip. TUT is not responsible for your inability to handle the trip’s difficulty.
  • Physical fitness: Most treks do not require specific preparation, but a reasonable fitness level enhances your experience. You are solely responsible for being fit, healthy, and in shape for the trip. It’s your responsibility to pack the right clothing and equipment.
  • Disclosing health issues: Any disability, pregnancy, mental or physical condition, or any other medical condition that might affect your ability to complete the trek must be disclosed to TUT at booking.
  • Failure to disclose: Failure to disclose information can result in immediate trip termination with a full cancellation penalty. TUT reserves the right to decline, accept, or remove from a trip any participant whose condition could endanger others, including themselves.

Program Dates

  • Verification: You are solely responsible for verifying the correct dates mentioned on your travel documents.

Documents

  • Required documents: All necessary documents should be presented in advance. TUT is not accountable for incomplete trip formalities due to missing documents.

Itinerary

  • Safety and enjoyment: TUT prioritizes your safety and enjoyment. Therefore, TUT reserves the right to modify or cancel the trip (or part of it) due to unforeseen circumstances, including acts of God, road blockages, political unrest, flight cancellations, delays, sickness, and events beyond TUT’s control. You will bear any extra cost arising from such circumstances. TUT will inform you of such changes in advance or while on the trip, if possible.

Refund Policy

  • Voluntary trip cancellation: No refunds (partial or otherwise) will be made if you voluntarily leave or drop out of a trip after it has begun. No refunds will be made for unused services.
  • TUT cancellation: If TUT cancels the trip due to unforeseen circumstances, we will suggest an alternative trip/date or a voucher (valid for one year). You can choose the alternative trip, voucher, or another trip of your choice. You may need to pay the difference in cost, if applicable. TUT will not be liable for additional fees, travel arrangements (including flight cancellations, railways, hotels, visa costs, onward arrangements), etc., under such circumstances. Refunds will happen as per our cancellation policy.
  • Missed/unused services: Refunds are not possible for missed or unused services due to voluntary/involuntary termination (e.g., sickness, death in the family, late arrival).
  • Trip curtailment/alteration: TUT is not liable to pay any compensation for any loss arising from trip curtailment, alteration, extension, or cancellation due to any reasons. However, your maximum liability will be limited to the trip cost paid to TUT.

Communication

  • Email communication: All communication will be done through the email ID you provide on the registration form. TUT is not responsible for lost or delayed communication due to your incorrect email address. Please inform TUT of any email change at contact@trekuptour.com.

Luggage Responsibility

  • Your belongings: Baggage and personal effects are at your risk throughout the trip. You are solely responsible for your belongings on the trip. TUT is not responsible for lost baggage, goods, air tickets, passports, cash, traveler’s cheques, or any other travel document or item owned by you while on tour.
